1. Acceptance of Terms

By creating an account or using TrendsEngine ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

TrendsEngine is a sports statistics and market-data analytics platform. The Service provides historical performance trends, price comparisons across publicly available sports data feeds, and personal tracking/journaling features. The Service does NOT facilitate wagering, does NOT accept or hold funds for betting purposes, does NOT place bets or wagers on behalf of any user, and is NOT a sportsbook, betting exchange, or gambling operator of any kind.

3. Eligibility

• You must be at least 19 years old (the legal age in Ontario) to use this Service, or the applicable legal age of majority in your jurisdiction, whichever is higher.
• By using the Service, you represent that you meet this age requirement.
• The Service is not directed at, and must not be used by, anyone under this age.

4. No Financial, Betting, or Investment Advice

Nothing on the Service constitutes financial, investment, or betting advice. All statistical data, trend information, market pricing analysis, projections, and calculations are provided for informational purposes only. Any decision a user makes based on information from the Service — including any wagering decisions made elsewhere, on third-party platforms — is made entirely at the user's own discretion and risk.

5. No Guaranteed Outcomes

Statistical calculations, including pricing-discrepancy identification and trend data, reflect historical data and mathematical calculations. They do not guarantee any future outcome. Past performance of any statistical pattern does not guarantee future results.

6. Subscription & Billing

• The Service is offered on a recurring subscription basis at the price displayed at signup.
• Subscriptions automatically renew each billing period until cancelled by the user.
• Payment is processed by Stripe and is subject to their terms as well.
• Price changes will be communicated to subscribers at least 30 days in advance.

7. Cancellation & Refund Policy

• Users may cancel at any time through account settings; cancellation takes effect at the end of the current billing period.
• Refunds: subscription fees are generally non-refundable once a billing period has begun, except (a) where required by applicable law, (b) verified billing error on our part, or (c) at our sole discretion.
• 1-day trial: a payment card is required at signup. If you do not cancel within 24 hours of signing up, you will be automatically charged for the plan you selected.

8. Prohibited Use

Users may not: circumvent access controls or the paywall; scrape, resell, or redistribute data from the Service; use the Service unlawfully; interfere with security or infrastructure; misrepresent age or eligibility.

9. Intellectual Property

All content, design, software, and branding are the property of TrendsEngine and may not be copied or redistributed without permission.

You retain ownership of any information you enter into your account (such as watchlist selections or personal notes). By entering it, you grant us a limited licence to store, process, and display it back to you solely to operate the Service. If you send us feedback or suggestions, you agree we may use them without any obligation to you.

10. Disclaimer of Warranties

The Service and all data, statistics, and pricing comparisons within it are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any statistical data, trend, or pricing figure sourced from third-party feeds is complete, current, or free of error. You use the Service, and any information from it, at your own risk.

11. Third-Party Data & Services

The Service displays data drawn from third-party sports-data and odds providers and processes payments through a third-party payment processor. We do not control, and are not responsible for, the accuracy, availability, or terms of any third-party source, nor does referencing any sportsbook, league, team, or data provider imply that they endorse, sponsor, or are affiliated with TrendsEngine.

12. Limitation of Liability

To the maximum extent permitted by law, TrendsEngine and its operator(s) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including financial losses arising from decisions made based on information from the Service. The Service is provided "as is," without warranties of any kind.

13. Indemnification

You agree to indemnify and hold harmless TrendsEngine from claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Force Majeure

We are not liable for any delay or failure to perform caused by events outside our reasonable control, including outages at our hosting, data, or payment providers, internet or power disruptions, natural disasters, labour disputes, or government action.

15. Account Termination

We reserve the right to suspend or terminate any account that violates these Terms, engages in fraud, or misuses the Service, with or without notice.

16. Changes to Terms

These Terms may be updated periodically. Continued use after changes constitutes acceptance. Material changes will be communicated to active subscribers, such as by email or an in-app notice.

17. Dispute Resolution

If you have a dispute with us, please contact trendsenginesupport@gmail.com first and describe the issue; we will try in good faith to resolve it informally. If it isn't resolved within a reasonable time, either party may bring a claim in the courts of Ontario as described in the Governing Law section below. Nothing in these Terms limits any right you have under the Consumer Protection Act, 2002 (Ontario) or the Class Proceedings Act, 1992, including the right to bring a claim in court or to start or join a class proceeding.

18. Governing Law

Governed by the laws of the Province of Ontario and applicable federal laws of Canada.

19. General Provisions

• Severability: If any provision of these Terms is found unenforceable, the rest remain in full force and effect.
• Entire Agreement: These Terms, together with the Privacy Policy and Refund & Cancellation Policy, are the entire agreement between you and TrendsEngine regarding the Service, and replace any prior agreements on the same subject.
• No Waiver: If we don't enforce a provision right away, that doesn't mean we give up the right to enforce it later.
• Assignment: You may not transfer your account or these Terms to someone else. We may assign these Terms as part of a merger, acquisition, or sale of our business.
• No Partnership: Nothing in these Terms creates a partnership, joint venture, or agency relationship between you and TrendsEngine.
• Survival: Sections that by their nature should continue after your account ends — including Limitation of Liability, Indemnification, Intellectual Property, Dispute Resolution, and Governing Law — remain in effect after termination.
